Validation of European Patents in Finland and Sweden

In order to validate a European Patent in Finland and/or Sweden, the publication fee must be paid and the necessary translations must be submitted to the patent office(s) within three months of the grant of the European Patent.

To validate a granted European patent in Finland, a translation of the claims and the title of the invention ust be filed with the Finnish patent office. Similarly, for Sweden the claims and title must be translated into Swedish and filed with the Swedish office.

It is not necessary to translate the description of the patent into Finnish or Swedish if the text of the granted European patent is in English. However, if the text of the patent is in German or in French, it (and any other text in the patent, e.g. the drawings) must be translated, either into English or into Finnish/Swedish.

In Sweden, the translations must always be filed in Swedish.

In Finland, if the patent holder’s own language is Swedish, the necessary translations can also be filed in Swedish. For businesses, the business’s language is considered to be Swedish if the minutes of its meeting are kept in Swedish.
